Further Fuel for Our Fees Increase Fight
Since Ontario's wage-restraint law, Bill 124, has been found unconstitutional, a series of arbitrator decisions on hospital staff pay provides an interesting comparison to our 14-year fee freeze. In June, an arbitrator awarded 3.75 % and 2.5 % per cent for last year and this year to various hospital workers on top of the one percent per year they received under the law.
The arbitrator’s decision said (in one of those common sense perspectives we so appreciate) that reasonable wage rates aligned with inflation are a key component of the healthcare human resources crisis. Ontario Divisional Court Ruling Overturns LAT: Allows Claim for Catastrophic Impairment Without Direct Physical Connection to Accident and for Ignoring SABS Purpose as Consumer Protection
This case ruling, Kellerman-Bernard v. Unica 2023 ONSC 4423, as outlined in the excellent McLeish Orlando article, is a beacon of light at the end of the generally bad-news LAT tunnel. It offers a potential widening of the CAT benefits envelope and stands as (another) rebuke to the LAT putting a special emphasis on fostering fairness for people with “the most health needs” and not increasing their suffering and economic hardship. Shout out to Patrick Brown at McLeish Orlando for his presentation on this case at PIA’s Back to School conference.
